Version 5.0 extends edition 4.0 of 22 June 2026 for the launch of the real-estate vertical: the “Object” now covers a vehicle OR a property (apartment, house, condominium, etc.); the previous bans on non-vehicle listings and requests are removed; requirements that apply only to operating a vehicle (driving licence, roadworthiness and motor insurance, traffic rules) now carry a “vehicle only” carve-out, and separate requirements are introduced for property (the right to let the Object, habitability). New: when posting a vehicle request the Guest explicitly confirms holding a valid driving licence; the confirmation is recorded by the Operator and may be relied on in disputes and complaints.

This English text is an informational summary of Balm’s Terms of Service and EULA, version 5.0, effective 21 July 2026. The authoritative version is the Russian text at balm.rentals/ru/license. In case of conflict the Russian version prevails.

1. Acceptance

These Terms govern your use of balm.rentals and the Balm mobile apps for iOS and Android (the “Service”). The provider is Individual Entrepreneur Sergey N. Vikhlyaev, TIN 682004283576, OGRNIP 323680000023219 (the “Operator”). By installing the app, creating an account or otherwise using the Service you accept these Terms in full.

2. Licence

The Operator grants you a free, worldwide, non-exclusive, non-transferable licence to install the Balm app on your personal devices and to use it for its intended purpose: posting and browsing rental listings and requests, messaging counterparties, leaving reviews. Any other use requires a separate written agreement.

3. Nature of the Service

Balm is an information intermediary that connects owners (“Hosts”) of vehicles and of real estate (apartments, houses, condominiums) with renters (“Guests”). The rental object (“Object”) is a vehicle or a property. Balm is NOT a party to the rental contract, does not own the listed Objects and does not guarantee performance of the rental. All commercial terms (price, deposit, insurance, liability) are agreed directly between Hosts and Guests.

4. Eligibility

You must be at least 18 (or the age of contractual capacity in your jurisdiction, whichever is higher) and have full contractual capacity. Where the Object is a vehicle, you must hold a valid driving licence recognised in the country of use (in Thailand: a national licence or an International Driving Permit) and follow local traffic rules, including mandatory helmet use in Thailand and zero-tolerance on impaired driving. No driving licence is required to rent a property.

5. Listings

When you post a listing you confirm that you own the Object or are otherwise entitled to rent it out; that a vehicle is roadworthy, maintained and complies with local registration and insurance requirements (in Thailand, compulsory motor insurance under พ.ร.บ.), and that a property is habitable, meets applicable safety/sanitary standards and may lawfully be let (including any condominium/HOA rules and co-owner consent); that your photos are yours or licensed to you; and that all listing data is accurate. Non-vehicle and non-property listings are not allowed. Operator may refuse or remove listings without giving reasons.

6. Delivery and rental requests

The Service offers a requests feature. A Guest may post a request – a public ask for a vehicle to be delivered and/or rented, stating the desired vehicle parameters, conditions and location. Hosts with a matching active listing within range of the request location are notified and may respond; the parties then negotiate in the in-app chat.

A request is an invitation to treat by the Guest, not a public offer, and does not by itself create an obligation to enter into a rental. A Host’s response likewise creates no obligation to contract; all material rental terms are agreed by the parties themselves. Operator is not a party to the relationship between users (see Section 3).

By posting a request you confirm that its details are accurate, that you genuinely intend to rent on reasonable terms, and that the request does not breach applicable law, third-party rights or these Terms. Misleading, spam, fraudulent requests, or requests outside the categories the Service supports (vehicles and real estate), are prohibited. Requests are subject to prior moderation on the same principles as listings and other content (see Section 7, including objectionable-content rules). Operator may refuse, hide or remove a request without giving reasons and may restrict the requests feature for users who breach these rules. Processing of personal data for this feature (including request geolocation and matching against active listings) is described in the Privacy Policy.

Driving-licence confirmation (road safety). When posting a request for a vehicle, the Guest explicitly confirms holding a valid driving licence that meets the requirements of Section 4; a vehicle request cannot be posted without this confirmation. The fact, date and time of the confirmation are recorded by the Operator and linked to the Guest’s account. If the confirmation turns out to be untrue, the Operator may rely on the recorded confirmation when handling complaints, disputes and enquiries (including from Hosts, insurers and competent authorities, as described in the Privacy Policy and applicable law) and may apply the measures in Section 12. The Guest is responsible for the consequences of an untrue confirmation, including harm caused by driving without a valid licence.

7. Chat, reviews, complaints and content moderation

No spam, abuse, illegal content, copyright infringement or third-party personal data without consent. Operator may moderate or remove content and restrict chat features. Chat conversations (messages and shared media) are stored and processed on the Operator’s own infrastructure (its servers and object storage); retention is described in the Privacy Policy. Reviews must be honest and based on actual interaction. Report violations to balmforpartners@gmail.com.

Zero tolerance for objectionable content. Balm has a zero-tolerance policy towards objectionable content and abusive behaviour. We take active steps to ensure users do not post illegal, abusive, discriminatory, threatening, fraudulent, sexually exploitative or otherwise objectionable material. All listings, requests and reviews are moderated, and reported content is reviewed by the Operator.

User tools. Every listing and every other user’s profile provides a “Report” action (with a reason, and for the “Other” reason a free-text description and attached screenshots) and a “Block user” action. Blocking instantly hides the blocked user’s listings and messages from your feed and notifies the Operator of the objectionable content.

24-hour response. The Operator commits to reviewing reports of objectionable content and user-block requests within 24 hours and to acting on them by removing the offending content and/or ejecting the user who posted it.

8. User content licence

You retain ownership of content you post. You grant Operator a worldwide, non-exclusive, royalty-free licence to host, display, adapt for technical needs and use the content within the Service, plus 30 days after removal for backup and moderation. You warrant you have all rights necessary to grant this licence and you indemnify Operator against third-party IP claims.

9. Paid services and refunds

Core features are free. Paid features include VIP listing promotion and Partner placements. Prices are shown at the point of purchase. Refunds are available where the service was materially defective; requests go to balmforpartners@gmail.com and are processed within 30 days, save for mandatory consumer-protection rules that grant broader rights.

10. Disclaimer and liability

The Service is provided “as is” and “as available”. To the maximum extent allowed by applicable law, Operator’s aggregate liability is capped at the amount you paid Operator in the 12 months preceding the event giving rise to the claim, or RUB 5,000, whichever is greater. The cap does not apply to death, personal injury, gross negligence, wilful misconduct or to mandatory consumer-protection rules.

11. Indemnification

You will indemnify Operator from third-party claims arising from your breach of these Terms or applicable law, content you post, damages caused by the rented vehicle while in your custody, and unauthorised account access caused by your negligence.

12. Suspension and termination

Operator may suspend or terminate your account for breach of these Terms, illegal activity, fraud or prolonged inactivity (24+ months) with prior notice. You may close your account at any time.

13. Changes

Operator may amend these Terms. Material changes will be notified at least 14 days in advance. All versions are archived at balm.rentals/<lang>/license/versions.

14. Governing law and disputes

These Terms are governed by Russian law, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes are resolved by negotiation first; otherwise by the competent courts at Operator’s seat, unless mandatory law allows you to sue at your domicile.

15. App store provisions

When the app is obtained via Apple App Store, you acknowledge that this EULA is between you and Operator (not Apple); Apple has no support obligations for the app; Apple is a third-party beneficiary entitled to enforce this EULA against you. The Google Play Developer Distribution Agreement applies to apps obtained via Google Play.
